Ordinance on transport fares and conditions of carriage for occasional taxi traffic in the Hannover region (with the exception of the area of the state capital Hannover) of 16.12.2003 (Official Gazette of the Hannover Region No. 48 of 30.12.2003); last amended by the 9th ordinance amending the ordinance on transport fares and conditions of carriage for occasional taxi traffic in the Hannover region (with the exception of the area of the state capital Hannover) of 12.07.2022 (Official Gazette of the Hannover Region No. 34 of 01.09.2022)
Based on Section 51 Paragraph 1 of the Passenger Transport Act (PBefG) in the version of the announcement of August 8, 1990 (BGBl. I page 1690) last amended by Article 1 of the Act of April 16, 2021 (BGBl. I p. 822) in connection with Section 2 Number 4 c of the General Responsibility Ordinance for municipalities and districts for the execution of federal law (Allg.Zust.VO-Kom) of October 13, 1998 (Nds. GVBl. p. 661) in the amended version of December 14, 2004 (Nds. GVBl. p. 589) and on the basis of Sections 159 Para. 2 No. 3, 45 Para. 1 and 58 Para. 1 No. 5 of the Lower Saxony Municipal Constitution Act (NKomVG) of 17.12.2010, the Regional Assembly of the Hannover Region resolved the following ordinance on 12.07.2022:
(1) This ordinance applies to entrepreneurs who operate taxi services and have their registered office in the Hannover Region, excluding the area of the state capital Hannover.
(2) The Hannover Region, including the state capital Hannover, is determined as the compulsory driving area (§ 47 Para. 4 PBefG). This means that there is an obligation to transport within this area, even if passengers only want to use the taxi for a short distance (§ 22 PBefG).
(1) For trips whose destination is outside the compulsory driving area, the taxi drivers must inform the passengers before the start of the trip that the transport fare for the entire route can be freely agreed upon. However, the fare set for the compulsory driving area may not be exceeded. If no agreement is reached, the transport fares set for the compulsory driving area apply.
(2) For arrivals that go beyond 5 km from the registered office and do not lead back to it, the arrival is to be calculated from the 5 km limit. Within a 5 km radius of the registered office, no fee is charged for the arrival.
(1) The general fare consists of:
a) The base price,
b) The fee for the travel performance,
c) The fee for the waiting time, and
d) Surcharges.
(2) a) Base Price
The base price for using a taxi is 4.50 Euro for each trip. This price includes the fee for the travel performance for a distance of 35.71 meters or a waiting time of 10.29 seconds.
b) Fee for Travel Performance
The fee for the travel performance is 0.10 Euro for each additional 35.71 meters started. This corresponds to a kilometer price of 2.80 Euro.
c) Fee for Waiting Times
The fee for waiting time is 0.10 Euro for every 10.29 seconds started after an initial 120 seconds. This corresponds to an hourly rate of 35.00 Euro. Waiting time is any stopping or slow driving of the taxi up to a standstill speed of approx. 3.6 km/h.
d) Surcharges
1. Combo Taxi: For the transport of goods carried out at the express request of the passengers with a combo taxi (station wagon), a one-time surcharge of 6.00 Euro per trip is charged. This does not apply to the transport of wheelchairs.
2. Large Capacity Taxi (Van): For the transport of five to eight passengers with a large capacity taxi, a one-time surcharge of 6.00 Euro per trip is charged.
Special agreements on transport fares for the scope of this ordinance according to § 51 Para. 2 PBefG must be submitted to the licensing authority for approval before their introduction.
(1) The taximeter may only be switched on at the location specified by the customer - in the case of pre-orders, only at the specified time.
(2) A transport trip may only be started with a perfectly functioning taximeter.
(1) The taxi driver must assist passengers with getting in and out as well as with loading and unloading luggage free of charge.
(2) Luggage, with the exception of small hand luggage, must be stored in the trunk of the vehicle.
(3) Assistance dogs for people with disabilities must always be transported.
(4) The passenger can request a receipt for the fare. It must contain: name and address of the entrepreneur, order number, amount paid, route, date, and signature.
Violations of these regulations (e.g., refusing short distances, incorrect use of the taximeter, overcharging) can be punished with a fine of up to 10,000.00 Euro according to § 61 Para. 2 PBefG.
